On-call contracts: two changes to the fixed-hours offer rule from July 2021

The Collective Act SZW (Verzamelwet SZW) took effect on 1 January 2021 and amends, among other things, the rules on offering a fixed number of hours to an on-call worker.

The statutory scheme for on-call contracts was introduced a year ago. Once the employment contract has run for 12 months, the employer is required to make a written or electronic offer of a fixed number of hours within a month. Under the Collective Act, this is now adjusted on two points:

  • if the on-call worker accepts the offer, the fixed number of hours must start no later than the first day of the 15th month; and
  • the law states that the period for accepting this offer is at least one month. Following the change, the employee now has no more than one month to accept the offer.

These two changes will take effect on 1 July 2021.
