No work permit required for Ukrainian employees under the Temporary Protection Directive

Employers do not need to apply for a work permit for employees from Ukraine if they fall under the European Union’s Temporary Protection Directive. Requirements:

– The employee falls under the Temporary Protection Directive. This directive applies to refugees from Ukraine, giving them the right to work in the Netherlands.
– The employee has an employment contract.

The exemption applies from 1 April 2022, with retroactive effect to 4 March 2022.

Document from the IND
Refugees from Ukraine receive a document from the Immigration and Naturalisation Service (IND) confirming they fall under the Temporary Protection Directive. Not every refugee has this document yet. The exemption therefore applies until 30 May 2022 for all Ukrainians who can prove their nationality, for example with a passport.

Notification duty
If an employer wants to hire an employee from Ukraine, this must be reported to the UWV, using the form “Reporting the employment of a temporarily protected employee from Ukraine”. The form must state, among other things, the duration and scope of the employment, the role, and the salary.

Citizen service number (BSN) required
Without a BSN, a Ukrainian refugee cannot work in the Netherlands for a Dutch employer. A BSN is also needed to report payroll tax. Refugees from Ukraine can be registered in the Personal Records Database by declaring their residence and address at the municipality. They then become known to the IND and receive a BSN.
