Reorganizations and mergers (corporate employment law)

A reorganization or merger usually involves the loss of one or more jobs. For the employer, it is then important to have a good reorganization plan. We prepare this plan well for the employer.
The reorganization plan shall regulate any redeployment within the company, the selection criterion to be applied to the employees to be proposed for dismissal, the time and manner in which the employees concerned shall be informed, the manner of termination of the employment contracts with these employees and any redundancy plan to be offered.
The cost of a reorganization we assist is fixed. Those costs include the reorganization plan, the resignation requests, the UWV procedure, the termination agreement and negotiations with the employee on the termination agreement. For EUR 1,750 excluding VAT per departing employee, we will advise and assist you.

 

Works councils

 

In reorganizations where 20 or more employment contracts are terminated, the works council or employee representation (if any) will have to be consulted and affected trade unions will have to be informed of the reorganization plans.
