Changes in employment law as of August 2022

Stealing tompouces is no reason for instant dismissal, fair compensation
The employer (deka supermarket) has fired an employee on the spot for taking a damaged box of tompouces. The subdistrict court ruled that the employer had not communicated the zero tolerance policy clearly enough. The employee was wrongfully dismissed and is entitled to a fair compensation of EUR 6,000.

The inspection regulations do not apply during leave
The employee was wrongly dismissed with immediate effect for failing to comply with control regulations during illness. The employee was on leave at the time and was not bound by the control regulations. The employee is entitled to a fair compensation of EUR 50,000.

Unjustified dismissal after refusal to reintegrate
An employer must exercise restraint in giving instant dismissal to a sick employee who refuses to reintegrate. The law already provides for a sanction for refusing to cooperate with reintegration, namely a wage freeze.

Maximum transition payment increased
As of 1 January 2022, the maximum transition payment is EUR 86,000 gross or a gross annual salary, whichever is higher.

Executive wrongly accused of discrimination and harassment
In this case we assisted the employer (a university). Various conflicts had arisen between the employee and, among others, her direct supervisor. The employee accused the supervisor of discrimination and harassment. The employee was asked to stop making these allegations. Despite this, the employee posted several messages on social media with accusations against the employer and her supervisor.
